Altria (Big T) moves to Ban Vapor Flavors
| STATEMENT ON ALTRIA PRESENTATION TO CAGNY |
| Last week, Howard Willard, Chairman & CEO of Altria Group, Inc., presented to the Consumer Analysts Group of New York (CAGNY). During the presentation, Mr. Willard succinctly described Altria’s planned actions to address the increase in youth experimentation with electronic cigarettes, including: “Encourage FDA to take industry-wide action by banning retail and vape store sales of all non-traditional flavors until the youth issue is otherwise addressed, such as by the use of advanced age verification technology or pre-market authorization.” Altria’s position that the U.S. Food & Drug Administration (“FDA”) should ban the sale of all non-traditional flavors at retail and vape shops marginalizes harm reduction and does a disservice to adult smokers seeking lower risk alternatives to cigarettes for several reasons. In particular, (1) scientists have concluded that flavors assist smokers in quitting smoking cigarettes; and (2) current scientific literature demonstrates that flavors play little role in attracting teens to use vapor products. Altria’s view fails to adequately assess the net public health benefits of flavored vapor products and ultimately serves only to harm adult smokers while doing little to solve the concerns around youth usage. For these reasons, the Vapor Technology Association (“VTA”) disagrees strongly with the Altria’s planned course of action. VTA’s Position – Flavors are Essential for Smokers Seeking to Quit Combustible Cigarettes For the past three years, VTA’s position on vape shops and flavors has been clear and consistent: Flavor Bans and/or Restrictions are Unwarranted: Banning or restricting the sale of flavors is the wrong approach. Until science demonstrates otherwise, neither FDA nor any other governmental entity should act to ban or limit the availability and accessibility of flavors on the market to the detriment of adult smokers seeking to quit combustible cigarettes. Appeal of Flavors is Subjective: The appeal of particular flavors is subjective and not the reason most youth choose to initiate electronic cigarettes. Sound science does not support a plan that tries to categorize flavors as offerings which “should” or “should not” be sold. Focus Should Be on Prohibiting Inappropriate Marketing of Flavors: Prohibiting inappropriate marketing should be the focus of efforts to address the increase in youth experimentation with electronic cigarettes. VTA has introduced legislation in several states to affirmatively impose reasonable marketing restrictions. VTA Marketing Standards: VTA has repeatedly encouraged industry to adopt the VTA Marketing Standards for Membership which would serve to limit both access to and appeal of vapor products to youth. Flavors are Critical to Smoking Cessation: Adult smokers looking to vapor products as an off-ramp from combustible cigarettes deserve access to a wide variety of flavored products to allow for individualized choice in finding the product that works best for them. VTA presented a clear and unequivocal scientific case to FDA showing that flavors help adult smokers quit. Flavor Bans Directly Threaten Vape Shops: A decision to ban flavors from brick-and-mortar vape shops, even temporarily, will eliminate over 10,000 small businesses and un-employ tens of thousands of Americans that work for them. VTA’s Board of Directors follows the aforementioned principles, and VTA intends to continue to fight for flavors at all levels of government. Our membership has too much invested in the vape shop and retail store channels to equivocate on these issues and we will challenge any efforts to ban flavors at vape shops and retail stores. VTA’s Board of Directors is comprised of 16 companies that manufacture, supply, distribute and sell a variety of open and closed system products, including thousands of flavors. Anyone interested in the Truth about nicotine, such as smokers, concerned non-smokers, vapers, and their concerned family members should view this documentary. In fact, the globe can be educated, as much negativity surrounds the drug.

VTA Update: STATE OF THE STATE
As stated in our last briefing, the Vapor Technology Association has
experienced tremendous growth over the last year. The Association now
has lobbying representation on the ground in almost 40 States.
In the past two weeks, the VTA has hired representatives in
other states including California, Colorado, Massachusetts, Minnesota
and New Hampshire. These lobbying entities have been hired based on their superb track record of being effective
in their respective states and their belief in the causes advocated by the Vapor Technology Association.
As you are aware, our industry has seen hundreds of pieces of
legislation impacting us across the nation. The most significant
legislation being monitored includes taxation of vapor products, flavor
bans, Tobacco 21 and negotiations on responsible regulation
of our industry.
Taxation of vapor products bills have been introduced in the following 26 States:
- Arizona, California, Colorado, Connecticut, Hawaii, Illinois, Indiana, Massachusetts, Mississippi, Missouri, Montana, North Dakota, Nebraska, New Hampshire, New Jersey, Nevada, New Mexico, New York, Oregon, Rhode Island, Texas, Utah, Virginia, Vermont, Washington and Wyoming.
Flavor bans have been introduced in the following 10 States:
- California, Connecticut, Hawaii, Massachusetts, Montana, North Dakota, New York, New Jersey, New Mexico, and Washington.
Tobacco 21 has been introduced in the following 23 States:
- Arizona, Colorado, Connecticut, Hawaii, Illinois, Indiana, Iowa, Maryland, Michigan Minnesota, Mississippi, Nebraska, New Hampshire, New Mexico, New York, Oklahoma, South Carolina, Tennessee Texas, Vermont, Virginia, Washington, and West Virginia.
Going on Offense: Our team is introducing and/or discussing our own language related to licensure and marketing restrictions in the following 8 states:
- Arizona, Connecticut, California, New Jersey, New York, New Mexico, Oregon, and Washington.
Highlighted State Affairs Issues:
- Arkansas – 40% wholesale tax being proposed to fund infrastructure package.
- Colorado – H.B. 1033, which allows
local regulation of e-cigarettes, passed the House. VTA working on
Senate strategy to defeat the legislation
- Hawaii – S.B. 182 which
allows local counties to regulate e-cigarettes is scheduled for a
hearing 2/11. S.B. 1009, which would ban flavors, has a hearing on 2/13.
- Illinois – Governor and legislature propose a tax on vapor products as part of budget negotiations.
- Maine – S.B. 173, which
prohibits, beginning January 1, 2020, a person from selling, furnishing
or giving away a nicotine liquid container is scheduled for a hearing
2/19.
- Nevada – Senator Ratti will introduce a wholesale tax rather than the .05mL tax previously introduced.
- New Mexico – H.B. 502, 45% whole sales tax filed by the chair of House Tax and Revenue committee.
- Utah – Utah Governor Gary Herbert
released a budget containing language recommending vaping products be
taxed at the same rate as traditional tobacco products.
- Virginia – H.B. 26, which requires licensure of vapor manufacturers, distributors and retailers and bans internet sales is scheduled for a hearing in House Human Services on 2/14.
State Victories
Our lobbying advocates have been successful on several fronts this
year. A couple good examples of this just transpired in the following
states:
- South Carolina – H.B. 3274 pre-empts local regulation of vapor products moved out of committee and is set for debate this week.
- Montana – H.B. 312, which imposes a flavor ban was tabled in committee on 2/8/19

Christmas Holiday Shutdown 2018
It’s that wonderful time of the year. VapeSling LLC values family and that includes our employees and their family. Therefore we are closing our factory doors on a Holiday break for all at VSLLC to enjoy. Beginning December 19th and returning for New Years Eve light duty.
